Photography Services Offer Agreement

This is a public offer by ANLOU LIGHTWORKS LLC (“Photographer”), represented by Anna Lutsenko, authorized representative of ANLOU LIGHTWORKS LLC, to provide photography services under the terms below. By booking, confirming, or paying for the services, the Client accepts this Agreement in full.

1. Services

Services include the photography session, editing, and delivery of images. The exact number of photographs to be delivered will be discussed and agreed upon separately with the Client, depending on the specifics of the session and location. All agreements will be confirmed via direct communication (e.g., chat or email) between the Photographer and the Client.

Consultation regarding outfit selection and session preparation will be provided only after the deposit has been received.

Note: Sometimes the session may be limited to 50 minutes if restricted by the studio rental time.

2. Deliverables

The Photographer will deliver a minimum of 30 edited digital photographs per 60 minutes of the session, and a minimum of 100 original (unedited) photographs per 60 minutes of the session. The exact number of photographs may vary depending on the specifics of the session and location and will be agreed upon separately with the Client via direct communication (e.g., chat or email). All edited photographs will be delivered within 14 calendar days after the session.

3. Payment

The total price for the session depends on factors such as studio rental and session specifics. The Photographer’s full price list is published on the official website.

A deposit of $100 is required to secure the booking. The deposit covers consultation, reservation of session time, and preparation for the session, including sending preparation materials to the Client.

The remaining balance is due on the day of the session, by the end of the day, and can be paid via Zelle, PayPal, or in cash.

4. Cancellation

The deposit is non-refundable under any circumstances.

5. Rights

The Photographer retains all copyright to the photographs. The Client is granted a non-exclusive license to use the photographs for personal purposes unless otherwise agreed.

6. Photographer Use / Consent for Publication

The Client may, but is not required to, grant permission for the Photographer to use the photographs for promotional purposes, including portfolio, website, social media, exhibitions, and marketing materials. Permission may be communicated separately after the session via written confirmation (e.g., email or chat).

7. Weather Conditions and Rescheduling

Outdoor sessions are subject to weather conditions. If the Photographer determines that weather (including but not limited to rain, strong wind, or other conditions) may negatively affect the session, the Photographer will offer alternative available dates or time slots to the Client.
The Client may reschedule the session once for any reason, provided that notice is given at least 14 calendar days prior to the scheduled date.
Studio sessions are not affected by weather, and no rescheduling will be provided due to outdoor weather conditions.

8. Liability

The Photographer is not liable for any indirect damages or missed shots due to circumstances beyond control, including but not limited to weather, technical issues, or third-party actions.

9. Governing Law

This Agreement is governed by the laws of the United States.

10. Acceptance

By booking, paying the deposit, or otherwise confirming the session, the Client agrees to these terms and conditions. Upon receipt of the deposit, the Photographer commits to providing the scheduled photography services and delivering the agreed-upon deliverables in accordance with this Agreement.
