Photography Services Terms
This Agreement is entered into by and between ANLOU LIGHTWORKS LLC, represented by Anna Lutsenko (the “Photographer”), and the Client, upon booking a photography session or package (collectively, the “Parties”).
1. Services
The Photographer agrees to provide photography services under the session(s) or package selected and confirmed at booking, which may include a single session (e.g., maternity, newborn, or family) or a bundled multi-session package (e.g., maternity + newborn).
• Date, Time & Location: agreed individually between the Photographer and Client at booking.
• Duration: typically 50–90 minutes per session, depending on session type and location. For studio sessions, shooting time may be limited due to studio rental restrictions (see Section 6, Studio Policy).
• Sessions include outfit guidance, photography services, and professional editing. Outfit guidance is provided after the deposit is received.
• Any changes to date, time, duration, or location may be agreed upon via written communication (text message, email, or messaging apps) and shall be considered part of this Agreement.
2. Deliverables & Photo Selection Options
The Client may choose one of the following options at booking:
Option 1 — Photographer-Selected Favorites
The Photographer selects 35 images per session for editing. The Client receives the edited images along with all original images (after removal of duplicates, technical errors, and unusable shots — approximately 180–200 files) within 7 days after each session. Additional edited images may be purchased at $5 per image.
Option 2 — Client-Selected Favorites
The Client receives all original images (after the same removal process) within 7 days after each session, and has 30 days from delivery to select 35 images per session for professional editing. Edited images are delivered within 7 days after the Client submits their selection. Additional edited images may be purchased at $5 per image.
3. Gallery Access & Storage
• The online gallery is available for 30 days from the date of delivery. The Client is responsible for downloading and securely storing all files within this period.
• After 30 days, the Photographer does not guarantee continued storage and may permanently delete files from active storage systems.
• If access is needed after the gallery has expired, a re-delivery/re-upload request may be made within 1 year of the session date for a fee of $50 per request, subject to availability of archived files. This is a retrieval service based on existing backups, not a guaranteed storage extension.
• The Photographer is not responsible for loss of files after delivery.
4. Payment
• Total price is agreed at booking, based on the session(s) or package selected.
• A non-refundable deposit is required to secure the booking; the deposit amount is confirmed at booking and applied toward the total balance.
• For multi-session packages, remaining balances are due on the day of each respective session.
• Accepted payment methods: Zelle, PayPal, Venmo, Cash.
5. Rescheduling & Cancellation
• The deposit is non-refundable.
• The Client may reschedule a session once with at least 10 days’ notice. Requests made less than 10 days before the session are subject to Photographer availability and are not guaranteed.
Weather Conditions (Outdoor Sessions)
In the event of rain or unsafe weather, either party may request a reschedule; the final decision rests with the Photographer. Weather is assessed up to 3 hours before the scheduled time — if cancelled before then, the Client may reschedule at no cost or receive a deposit refund. If the Client has already arrived or is en route and conditions make the session unsafe or unfeasible, the session will be rescheduled or partially credited at the Photographer’s discretion. Weather-related changes do not constitute a breach of this Agreement.
6. Session & Studio Policy
The Client agrees to arrive on time. Late arrival may result in reduced shooting time without compensation; the Photographer is not responsible for lost shooting time due to Client delays.
If a session takes place in a studio (by default or by mutual agreement), studio time is strictly limited per the studio rental terms confirmed at booking, typically up to 50 minutes.
7. Package Validity (Multi-Session Bookings)
For bundled or multi-session packages, all sessions must be completed within 1 year from the date of the first session, unless otherwise agreed in writing. Where applicable (e.g., newborn sessions), scheduling within this window is subject to age-appropriate timing (typically from 5 weeks) and Photographer availability.
8. Location
Session location(s) are agreed individually between the Photographer and Client and confirmed prior to each session.
9. Copyright & Usage
Images are provided for personal, non-commercial use only. Permission must be obtained from the Photographer for any other use, including commercial use, resale, or alteration.
10. Portfolio Use & Privacy
The Photographer will not use images publicly without the Client’s permission. The Photographer may request permission to use selected images for portfolio, website, social media, or promotional purposes. The Client is under no obligation to grant permission.
11. Editing Style
All images are edited in the Photographer’s signature style — natural, high-quality color correction, exposure adjustments, cropping, and overall refinement for a cohesive look. Light skin retouching is included where necessary (minor blemish removal, temporary skin imperfections, under-eye adjustments) while maintaining a natural appearance.
Additional or advanced retouching — including but not limited to object removal, background alterations, color changes, or significant image manipulation — is not included in the standard package and is charged separately.
12. Limitation of Liability
The Photographer is not liable for delays or issues caused by the Client, location or studio restrictions, or unforeseen circumstances beyond the Photographer’s control. In the unlikely event the Photographer is unable to deliver images due to circumstances beyond control, liability is limited to the amount paid by the Client.
13. Governing Law
This Agreement is governed by and interpreted in accordance with the laws of the State of New York.
14. Acceptance
By booking a session and/or signing the corresponding service agreement, the Client confirms they have read, understood, and agree to these Terms.
